Two separate data breaches by cybercriminals against MGM Resorts International (MGM) in 2019 and 2023 resulted in the exposure of private information of tens of millions of MGM guests.
Following both incidents, multiple lawsuits were filed. In July 2024, plaintiffs in the lawsuits agreed to participate in joint mediation — In re MGM International Resorts Data Breach Litigation. In October 2024, the plaintiffs filed a notice of settlement, notifying the court that all parties were able to resolve the cases.
On. Jan. 22, 2025, Nevada District Judge Gloria M. Navarro issued an order granting plaintiffs’ unopposed motion for preliminary approval of a $45 million class action settlement in the case.
“We are very pleased with the judge’s decision,” said J. Gerard Stranch IV, founding and managing member of Stranch, Jennings & Garvey, PLLC, who served as a co-lead for the 2023 case leadership team. “A data breach is not just a technical issue; it exposes sensitive information to criminals and can lead to irreparable damage to an individual’s reputation along with significant remediation costs to fix the damage. The long-term impact can be devastating.”
According to Judge Navarro’s order, all settlement class members may submit a claim for a loss cash payment for up to $15,000 per settlement class member. To receive settlement class member benefits, settlement class members “must accurately and timely” submit a claim by June 3, 2025, through the settlement website or via the U.S. Mail sent to the settlement administrator at the address designated on the claim form.
The final approval hearing is scheduled for June 18, 2025.
